Terms of Service

These terms govern your use of the Simply Will app and website. Please read them carefully — by using Simply Will, you agree to them. They include important limits on what our service is, and is not.

Last updated: 4 September 2026 Provider: DRGNFLY Studios Ltd Jurisdiction: England & Wales

01 Introduction

These Terms of Service ("Terms") are a legal agreement between you and DRGNFLY Studios Ltd ("Simply Will", "we", "us", "our") and govern your use of the Simply Will mobile application and website (together, the "Service").

By creating an account, purchasing a plan, or otherwise using the Service, you confirm that you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

02 About us

Simply Will is a trading name of DRGNFLY Studios Ltd, a company registered in England & Wales (company number 17398836), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. You can contact us at support@simplywill.co.uk.

03 Who can use Simply Will

To use the Service to create a will, you must:

  • be at least 18 years old;
  • be domiciled and resident in England or Wales, with your estate governed by the law of England & Wales;
  • have the mental capacity to make a will (that is, you understand what a will does, the extent of your estate, and the claims of those who might expect to benefit); and
  • be making the will freely and voluntarily, without pressure from anyone else.

Our wills are designed for England & Wales only. They are not suitable for people domiciled in Scotland, Northern Ireland, or elsewhere, whose succession laws differ.

04 What Simply Will is — and is not

Simply Will is a self‑service tool that helps you produce a will document from the information you provide, structured to meet the requirements of the Wills Act 1837 for England & Wales.

Important — we do not provide legal advice

DRGNFLY Studios Ltd is not a law firm, not a firm of solicitors, and not a regulated legal services provider. We do not provide legal, tax, or financial advice, and nothing in the Service should be taken as such. Using Simply Will does not create a solicitor–client relationship.

The guidance in the app is general information only. For anything beyond a straightforward estate — for example business interests, overseas property, trusts, blended families, potential inheritance tax, or claims against your estate — you should take independent advice from a qualified solicitor. We will flag where your situation may benefit from specialist input, but the decision is yours.

05 Your will and its legal validity

A will created with Simply Will is not legally valid until it has been correctly signed and witnessed. Under the Wills Act 1837, this generally means:

  1. you sign the will (or acknowledge your signature) in the presence of two witnesses who are both present at the same time; and
  2. each witness then signs the will in your presence.

Your witnesses (and their spouses or civil partners) must not be beneficiaries of your will, or any gift to them may fail. We provide a clear witness guide to help you do this correctly, but:

  • we are not present when you sign, and cannot verify that execution was carried out correctly; and
  • the responsibility for validly signing, witnessing, and safely keeping your original signed will rests with you.

We cannot guarantee that a will produced by the Service will achieve any particular legal or tax outcome, or that it will be free from challenge, particularly where the information you provide is inaccurate or incomplete, or where your circumstances are complex.

06 Your responsibilities

You agree to:

  • provide accurate, complete and up‑to‑date information — the quality of your will depends on it;
  • review your generated will carefully before signing it;
  • keep your will up to date as your life changes (marriage or civil partnership, for example, usually revokes an existing will);
  • correctly sign, witness and store your original signed document; and
  • keep your login details secure and not share your account.

07 Your account

You are responsible for maintaining the confidentiality of your account and for all activity under it. You must notify us promptly at support@simplywill.co.uk if you believe your account has been accessed without authorisation. We may suspend or close accounts that are used in breach of these Terms.

08 Plans, pricing & payment

Annual Updates Renewal£9.99/yrOptional. Continue making updates to your will after your first 12 months. This does not renew automatically — you choose to purchase it again each year.
Partner Referred Complete£19.99 one‑offThe Complete plan at a reduced price when you're referred by an existing Complete plan holder.

Purchases are made through the Apple App Store and are also subject to Apple's own terms. Prices are in pounds sterling and include VAT where applicable. We may change our prices from time to time, but a change will never affect a purchase you have already made.

09 Cancellation & refunds

Your 30‑day guarantee

We offer a 30‑day money‑back guarantee. Because all purchases are processed through the Apple App Store, Apple — not us — holds your payment and controls the App Store's refund process; we do not have the ability to issue refunds directly. To request one, use Apple's own refund process at reportaproblem.apple.com, or via Settings → [your name] → Media & Purchases → Purchase History on your device. Where you request a refund within 30 days of purchase because you haven't finished your will yet, we will not contest or dispute the request with Apple. If you have any trouble with this process, contact support@simplywill.co.uk and we'll help.

Your statutory rights

As the Service is digital content supplied to you immediately, you agree that supply begins as soon as you start using it, and you acknowledge that this may affect the standard 14‑day cancellation right under the Consumer Contracts Regulations 2013. This does not affect your rights under the Consumer Rights Act 2015 to digital content that is of satisfactory quality, fit for purpose, and as described — nor your 30‑day guarantee above, which is more generous.

10 The vault & shared access

Your digital vault stores the documents you create or upload. You are responsible for the content you upload and confirm you have the right to store it. We recommend you also keep your original signed will in a safe physical location and tell your executor where to find it.

The Service lets you notify your executor and share vault access with them via a secure, tokenised link you initiate from within the app. If you do, you authorise us to make the relevant documents available to that person. You choose who to notify, and should only share access with people you trust.

11 Acceptable use

You agree not to misuse the Service, including by attempting to access it unlawfully, interfering with its security or operation, using it to create a document for anyone other than yourself, or using it for any unlawful or fraudulent purpose.

12 Intellectual property

The Service, including its software, design, brand, and document templates, is owned by or licensed to DRGNFLY Studios Ltd and protected by intellectual property laws. You may use it only as permitted by these Terms. The content you enter, and your completed will, belong to you — we simply store and process them to provide the Service.

13 Availability & changes to the Service

We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted or error‑free, and we may carry out maintenance or updates. We may add, change, or withdraw features. If we ever decide to discontinue the Service, we will give you reasonable notice and a means to export your documents.

14 Disclaimers & limitation of liability

Nothing in these Terms limits or excludes our liability for anything that cannot lawfully be limited or excluded — including death or personal injury caused by our negligence, fraud, or your statutory rights as a consumer.

Subject to that, and because Simply Will is a self‑service tool and not a provider of legal advice:

  • we are not liable for loss arising from inaccurate or incomplete information you provide, or from a will that is not correctly signed, witnessed, or stored;
  • we are not liable for losses that were not reasonably foreseeable, or for the outcome of the administration of your estate; and
  • where we are liable, our total liability to you is limited to the amount you paid for the Service, except where the law requires otherwise.

We provide the Service to you as a consumer for personal use only, and we are not liable for any business losses.

15 General

We may update these Terms from time to time. If we make significant changes, we will notify you in the app or by email, and update the "Last updated" date above. If any part of these Terms is found to be unenforceable, the rest will continue to apply. We may transfer our rights and obligations under these Terms to another organisation, which will not affect your rights. A person who is not a party to these Terms has no rights to enforce them.

16 Governing law & jurisdiction

These Terms, and any dispute arising from them or the Service, are governed by the law of England & Wales. You and we agree to submit to the exclusive jurisdiction of the courts of England & Wales, although if you live in another part of the UK you may bring proceedings in your local courts.
